Common eligibility timing

  • Dismissed with prejudice / acquitted cases are generally eligible immediately, and many newer cases are automatically expunged after 30 days.
  • Misdemeanors and violations are commonly tied to a 5-year waiting period after completion of sentence.
  • Eligible Class D felony convictions generally cannot be filed until 5 years after sentence completion or successful probation/parole completion, whichever is later.
  • DUI expungement timing is often longer and may involve additional limits.

Important practical notes

  • The court system makes the final decision, not a website or screening tool.
  • An eligibility result is helpful, but only a judge can actually grant an expungement.
  • If the prosecutor objects to a felony application, a hearing may be scheduled.
  • If granted and completed, the record is generally removed from official state-performed background checks.

Kentucky cases can involve government and court fees depending on the case type. Our base service fee starts at $150, separate from any state or court fee, and reflects the work involved in helping manage and move the process forward.

We aim to keep pricing transparent up front, while also making the process much easier on the client.

Dismissed / Acquitted

Usually $0 filing fee

Many dismissals and acquittals do not require a filing fee, and some are automatically expunged depending on timing and case type.

Misdemeanor / Violation

$100

Misdemeanor and violation conviction expungements are commonly associated with a $100 court filing fee per case.

Eligible Class D Felony

$300 + $40 certification

Kentucky’s current official felony process includes a $50 filing fee, a $250 expungement fee if granted, and a $40 expungement certification cost.

Our service fee

Our base service fee starts at $150 and is separate from Kentucky court and government fees. Estimated totals can vary depending on case type, number of cases, offense level, and whether additional filings or work are needed.

What happens after expungement?

  • Once completed, the matter generally should not appear on official state-performed background checks.
  • Courts and agencies are directed to respond that no record exists on the matter.
  • The person generally does not have to disclose the expunged record on employment, credit, or similar applications.
  • For felony conviction expungement, the original conviction is vacated and dismissed before the record is expunged upon full payment.

One important limitation

Kentucky places limits on felony conviction expungement. In many situations, a person is limited to one felony expungement unless multiple eligible offenses arose from the same incident. Case details matter, so that part should always be reviewed carefully.
